Dick,

Today I got judgment in Divine's Small Claim case. As judge stated in
his courtroom I must sue the association, not Devine personally.
Although Devine is clearly guilty, unless it would be a criminal case,
some judges don't want to rule against the so called volunteer
directors because the entire HOA industry (the house of cards) would
fall apart.

So since you have "revised budget" now we have brand new ball of wax and
I no longer need to sue for the budget.

However, the budget was revised after May 1, 2005 which is deadline for
its lawful distribution, therefore, you must [obtained the approval of
owners, constituting a quorum, casting a majority of the votes at a
meeting or election of the association conducted in accordance with
Chapter 5 (commencing with Section 7510) of Part 3 of Division 2 of
Title 1 of the Corporations Code and Section 7613 of the Corporations
Code. For the purposes of this section, "quorum" means more than 50
percent of the owners of an association.] Civ. 1366(a).

Please notice that reduction quorum to 25% isn't applicable to section
1366(a).

So I'm giving you 30 days to fully comply with Civ. 1366(a) or I'll
file against the HOA for violation of Civ. 1366(a).
