FOREWORD
1. These rules and regulations have been designed by the Board of
Directors March 11,2002 under the authority of the Condominium
Documents, to make living in our condominium pleasant and comfortable.
In living together, all of us not only have certain rights but also
certain obligations to other owners. We must remember that the
restrictions we impose upon ourselves are for our mutual benefit and
comfort. The following rules don't supersede the Declaration of
Condominium or the Articles of Incorporation or the By-Laws or any
other legal obligations of the owners of the Portofino. Every effort
will be made by the Board of Directors to enforce these rules and
regulations.
2. Apartment living requires that each owner regulate the occupancy and
use of his apartment so as not to unreasonably or unnecessarily disturb
any other resident in the occupancy and use of his apartment.
3. Rules regarding leasing, sales and houseguests are included,
recognizing that regulatory and procedural actions in these areas are a
responsibility of the Board of Directors. These rules are included for
the purpose of providing all owners with information and guidance for
apartment occupancy. The scope of these rules is representative of
rules in popular use among Florida condominiums and represents
generally accepted practice for control- ling apartment occupancy.
4. Conduct generally offensive to other owners, or behavior disturbing
to their peace and comfort will be considered a violation of the rules
even if not specifically covered. Owners will be held responsible for
the conduct of their employees, guests, lessees, children and pets.
5. Complaints regarding violations of the rules by other owners, their
lessees or guests will be directed to the Board of Directors of the
Portofino Condominium, who will, so far as they are able, secure
compliance with the rules, and cessation of any objectionable behavior
or condition.
6. Report of persistent violations should be reported in writing and in
aggravated situations reported to the building manager who will report
to the Board, who will take such action as may be necessary.
7. Your Portofino Ownership Documents contain basic "Rules and
Regulations of the Association". When you signed these documents, you
agreed to abide by and uphold rules and regulations as adopted by your
Board of Directors. All residents, owners or guests are urged to read
these rules and regulations carefully and to cooperate in their
enforcement so that all may enjoy the use of their apartments and
Portofino facilities to the fullest. When all uphold the high
standards planned by your Board of Directors for our home, then all
will get the greatest benefits from Portofino Condominium living.
8. The Board of Directors is always interested in hearing from owners
in writing or e-mail to the manager as to the improvement of these
rules and regulations or of any other services designed to make living
in the Portofino more comfortable and more pleasant.
9. These Rules and Regulations may be changed from time to time at the
discretion of the Board of Directors. Notices of changes made will be
provided and copies will be distributed to owners, renters, and/or
residents. It is the responsibility of the unit owner to notify
tenants/guests of the most current rules.
10. Additional copies of these Rules and Regulations may be obtained
from the Condominium office at a cost of $5.00 (five dollars) per copy.
HOUSEKEEPING
1. Flowerpots, boxes and other objects will not be placed on window
ledges or suspended outside windows or doors.
2. Rugs, mops, cloths, brooms and vacuum cleaner bags shall not be
dusted, shaken or dried from the windows, in the hallways, balconies or
stairways.
3. Radio or TV antenna may not be installed or attached outside the
apartment or balconies without board approval.
4. An owner and/or resident shall not store any flammables, paints,
explosives, corrosive or poisonous liquid or materials in storage areas
or hallway closets which may create a fire or health hazard. The
building manager shall have the authority to enter a storage unit and
immediately remove such substances at unit owner's expense.
5. No changes by way of additions, painting, decorating or alterations
to the exterior of the building, including balconies, entrance to
apartments are to be changed or altered by the association only, as
they are a common area except for approved storm shutters.
6. Laundry, bathing apparel or clothing shall not be placed on the
balcony railing or in the balcony area except on furniture where it
will be inconspicuous.
7. Do not throw cigars, cigarettes or anything else or sweep dirt or
water from your balcony.
8. Hallways, stairwells, common landings and exterior balconies must
not be obstructed in any manner. Any penalty or violation assessed to
the Association and caused by a unit owner, their tenant or guest will
be collected from the unit owner.
9. Cans, supplies, milk cartons, laundry or dry cleaning shall not be
placed in the halls or hung on exterior of hallway doors.
10. Tables with unfastened glass or Plexiglas tops shall not be placed
on the balcony.
11. Because of the solid construction of the Portofino, some sounds are
transmitted through floors and ceilings. Please open and close storm
shutters and sliding doors to balconies and shower doors in bathrooms
slowly to reduce the noise carried from their tracks to other
apartments.
12. Please be mindful at all times of your neighbors' right to quiet
before 7 a.m. or after 11 p.m.
13. Avoid using the trash chute before 7 a.m. or after 11 p.m.
14. All trash or waste is to be placed in a bag that is tightly closed,
securely fastened, and placed in the trash chute. This includes litter
boxes and other waste. No biomedical waste shall be placed in the
chute. No paint cans, or combustible materials should be thrown down
the chute.
15. Use your disposal unit for food wastes, liquids, vegetables, etc.
Such materials stick to the chute, fouling it and causing offensive
odors in the service elevator, lobby, trash room and garage.
16. Paint cans, newspapers, bottles or other hard substances are not to
be put down the chute. All newspapers (including advertising circulars)
must be placed in the marked recycling container outside the north
garage-level door across from the elevator. All cans (excluding cans
under pressure), bottles and plastic must be rinsed (to limit
attraction to scavengers and odor) and placed in marked recycling
container outside the south garage-level door across from the elevator.
Other items should be placed outside Intracoastal facing doors near
trash room or, if subject to being blown away, inside the doors across
from elevators.
17. When placing trash in the chute, don't put your arm or hand beyond
the door-shelf area. Place the trash on the door-shelf and close the
door briskly. Trash coming down the chute from floors above could
cause serious injury to your arm or hand.
18. Be sure that the trash chute door is firmly closed after use to
prevent odors from permeating the room and hallway.
19. Nothing is to be attached to the balcony railings, temporarily or
permanent except the United States flag or holiday decorations, which
must be firmly attached. Plaques, decorations or other attachments
must not be affixed either temporarily or permanently to the balcony
railings except firmly attached sockets for United States flagstaffs
and/or holiday decorations. Hallway areas may be decorated at the
discretion of owners on each floor subject to mutual approval of both
unit owners.
20. Barbecue or cookout grills, torches or items with an open flame
must not be used on balconies.
21. Residents are not to use condominium property for their personal
use in their apartments. Residents violating this rule will be charged
according to the value of the property.
22. Owners are responsible to keep their own halls clean.
23. Before vacating a unit, it is highly recommended that unit owners,
renters, or houseguest's turn off the water, unplug the water heater,
and leave the air conditioning on.
24. Occupants may not be on the roof.
25. Arrangements to use the service elevator for an extended period of
time must be made with the Manager. Elevator padding is required for
moving large objects in or out. Moving time is restricted to the hours
between 8:30 a.m. and 5:00 p.m., Mondays through Fridays. No moving
will take place on Saturdays, Sundays or holidays, except as approved
in an emergency. [This was # 13 under Security in prior document.]
26. Lighting fixtures or any other item visible from the street or
Intracoastal that materially change the appearance of the building are
prohibited.
27. Linings of drapes and window coverings visible from the exterior of
the building must be of a neutral color.
SECURITY
1. All owners will leave a key or keys to their apartment, sealed in a
signed envelope, with the Manager, in order for him to cope with
emergencies affecting their apartment during their absence. Any time
an envelope is opened, a Board member or fireman or policeman must
enter with the Manager and the owner will be notified within 48 hours
of the reason for entry. It is the policy of the Board that two people
must be present every time a unit is entered.
2. Leaks, floods, or other damage; endanger all units and common
property. Units may be immediately entered to check for sources of
leaks, flood and water damage.
3. In order to provide security, all efforts will be made by your
staff to maintain maximum security at all times. However, since it
will be impossible to exercise complete surveillance, the cooperation
of residents is a necessity. Please keep all apartment doors locked at
all times whether you are in the apartment or not. Do not open
entrance doors to strangers.
4. A minimum of two entrance keys will be issued per apartment without
charge. Keys will be issued for permanent residents of an apartment in
excess of two people upon receipt of $100.00 (hundred dollars) deposit
per key refundable when the key is returned. One additional key may be
issued for guests when the owner is in residence, upon receipt of a
$100.00 (hundred dollar) deposit refundable when the key is returned.
The key must be returned when the guests leave. If a key is stolen, a
replacement key may be purchased for $50.00 (fifty dollars) with a
police report.
5. As a matter of security, the bottom stairway doors must be kept
locked at all times from the outside.
6. Please report any person acting suspiciously or any disturbing
incident immediately to the Manager or to the security guard.
7. No solicitors of any type will be permitted in the building at any
time, except by individual appointment with a resident.
8. Personnel employed/retained/ engaged by residents, full or
part-time, are the responsibility of the unit owner. The personnel
must display the Portofino guest-parking sticker on the dash of their
car or truck.
9. Residents must display the "Portofino" decal on their cars to assist
the guards in permitting entry.
10. The beauty and appearance of our elevators will be preserved only
if care is taken not to mar or scratch interiors.
11. In the event of a power or mechanical failure, the elevator will
stop temporarily. The building's emergency generator will start and
after a short interval will provide power to the elevator and to
emergency lighting.
12. In the event of a mechanical failure causing the elevator to stop,
sound the alarm by pushing the alarm button in the elevator and be
patient. If there is no response from building personnel or a Board
Member, the phone in each elevator will connect you to our elevator
maintenance company, which can come to your rescue.
13. It is recommended that elevator use be avoided during thunder and
lightning storms as most power failures occur during such storms.
14. Each owner who plans to be absent from his apartment for more than
24 hours is responsible for removing everything from his balcony or
closing shutters, and designating a responsible firm or individual to
care for his apartment, to avoid and remedy storm damage. The name of
said firm or individual must be given to the manager. Such right to
accept responsibility also admits liability of the persons or person
entering said apartment for subsequent losses of property. (See also
General Rules and Information, herein)
15. In owner's absence the Manager must be informed by signed or
written authority to grant entry to owner's apartment to workmen,
employees or contractors. Without such authority, entry definitely
will not be permitted. The mere possession of an apartment key will
not entitle the holder entry to an apartment. The owner agrees that he
is responsible and liable for all acts of his agents.
16. The City Fire Marshal conducts periodic inspections to check
violations of the fire laws, including blocking open corridor doors
leading to the walkway and to stairways at the top of the building.
Violation of this law renders the Condominium liable to a $500.00 (five
hundred dollar) fine. The unit owner is responsible for any such
fines.
PROPER CONDUCT
1. No radio, television, hi-fi or musical instrument shall be operated
at any time in a manner, which is annoying or offensive to other
occupants of the building.
2. Owners, their renters, residents or guests must not use an apartment
as a place of business.
3. No public sale of merchandise or furnishings shall be allowed in any
apartment unless authorized by the Board of Directors.
4. Children shall not be permitted by residents to play in public
halls, stairways, public rooms, lobby or elevators and particularly
will not be permitted to interfere with the operations of the
elevators. In a building such as the Portofino, it is presumed that
parents or custodians will teach children to act in a proper manner and
not in any way inconvenience any of the other residents. Owners are
responsible for any damage caused by their children or guests. Claims
for personal injuries are the responsibility of the owner-host, not the
corporation.
5. If a problem of misconduct is so serious as to render immediate
corrective action imperative, the Manager or security force is
authorized to act to correct it and will fully report such action to
the Board of Directors at the earliest practical time.
ATTIRE
1. There is no question that Florida lifestyle calls for informal
attire. Colorful sports clothes are an integral part of our
sub-tropical clime. The sunshine, warm temperatures and relaxed
atmosphere encourages the wearing of bathing suits and less formal
attire. But there is a time and place for everything, and we trust you
to use good taste and discretion.
2. Residents and their children and guests shall wear street clothes in
the common areas of the Portofino except when going to and from the
swimming pool. (See Recreation Facilities)
3. Footwear and top wear must be worn at all times in the common areas,
except in the immediate vicinity of the pool.
PARKING SPACES
1. No watercraft, trailers, campers, recreations vehicles (RV's) or
commercial vehicles will be permitted to park on the property except
for contractors performing work at Portofino. See #13.
2. Lessees will use "Assigned" parking space allocated to the owner.
3. Owners who don't use their "Assigned" spaces may authorize
another resident to use their allocated spaces, but shall notify the
Manager of such arrangements in writing.
4. Be sure to park your car well within the lines designating your
space. If you encroach on your neighbor's space, you only create
dissention, and may cause damage to cars.
5. All driveways and entrances must be kept clear.
6. Drive slowly (5 miles per hour) and with care through the garage and
parking areas.
7. Guests must have parking passes displayed on dashboard or in window.
Parking passes are distributed through the manager's office. If a
resident needs more parking passes to give their guests, the resident
should contact the building manager. Unit owners must have Portofino
parking stickers displayed in their vehicle.
8. Motorcycles must be parked in a parking space. They may not be
parked on the grass or between parking spaces.
9. Any car not parked in compliance with these rules and regulations
may be removed at the owner's expense or other means of enforcement
available to the Association may be used to obtain compliance.
10. No major repair work will be permitted on vehicles on the premises.
Only work of an emergency nature will be performed.
11. When walking through the garage, keep to the driveways as a safety
measure. There is the possibility of slipping on spilled oil or grease
when walking across parking spaces. PLEASE BE CAREFUL.
12. Cars may be washed only in the area provided.
13. Contractors must park in the designated contractors area, unless
other arrangements are made with the building manager. Residents or
guests are not permitted to park in designated contractor area Monday
through Friday from 7:45 AM to 5:00 PM. Oversized vehicles are not
permitted to park inside the gate.
GUESTS
DEFINITION:
A Guest is a person sponsored on the premises, grounds including docks
and boats docked at Portofino of the Portofino Condominium, Inc. by an
Owner or Lessee. A Guest is distinguished from an Occupant in that the
Board of Directors must approve an Occupant in advance. Guests who are
sponsored for a period longer than 30 (thirty) days are determined to
be Occupants, and approval of their occupancy must be obtained by the
Board.
COMMENT:
The Board of Directors will base approval on proposed Occupants on a
case-by-case basis.
Guests While Owner/Lessee is in Residence
1. Owners/Lessees may have guests as they wish while they are in
residence. The Owner/Lessee is responsible for his guests' behavior
and decorum.
2. All strangers using the facilities of the Portofino are subject to
question by the Manager, Board of Directors and/or security guards if
they are not identified.
3. Guests who are not overnight guests using common area facilities
such as pool, etc., must be accompanied by the person sponsoring such
guests.
Guests While Owner/Lessee is Not in Residence
1. House Guests to be sponsored while Owner isn't in residence must be
registered with the Manager at least 7 (seven) days prior to their
arrival. The request for admission will be submitted by the Owner with
a duly signed letter, which will also state the proposed length of
stay. Guests upon arrival will be given a copy of the Rules and
Regulations, following an interview with the Manager or Board Member to
assure understanding thereof. The cost of distributing the Rules and
Regulations will be charged to the Owner. The Guests will also be
required to sign a statement to the effect that they are bona fide
guests and not Lessees. The Owner will be held responsible for Guests'
actions. Admission of Guests is a privilege and may be withheld if the
privilege is abused.
2. Guests accompanied by pets will be refused admittance.
3. In the Owner's absence, family members who are under 18 may not have
guests of their own past midnight.
4. The Owner is responsible for providing the necessary keys to their
guests.
5. Apartment shall be used for single-family occupancy only. The
number of occupants shall be limited in accordance with the normal
sleeping facilities of the apartment.
6. Restriction on Number of Guests
a. Subject to the foregoing, and while the Owner isn't in residence,
the number of guests (whether they be individuals or single families)
which may occupy an apartment of the Portofino is limited to not more
than one such house guest (individual or single family) in any calendar
quarter and not more than four such house quests in anyone calendar
year. The maximum number of such houseguests in a two bedroom is four
people and the maximum number of such houseguests of a three bedroom is
six people. This restriction applies to brothers, sisters,
brothers-in-law, sisters-in-law and all distant relatives as well as
friends. The only exception to these restrictions are as follows:
b. This restriction does not apply in the case of apartments owned by
individuals to the immediate families of the apartment owner(s), which
include the spouse, children, children-in-law, grandchildren (when
accompanied by at least one parent), parents, grandparents, parents-in-
law or grandparents-in-law of the apartment owner(s).
c. In the case of apartments owned by corporations: To the presently
serving president of the corporate owner and his or her immediate
family as defined in (b) above.
d. In the case of a trust or any other artificial person: To the
principal beneficiary and his or her immediate family as defined in (b)
above.
Guests Generally
1. Day guests may not use the facilities of the Portofino unless the
resident is present, unless an arrangement is made with the building
manager.
PETS
1. The keeping of a dog or other pet at the Portofino isn't a right of
an owner of an apartment but is a privilege available only to owners as
such in residence. This conditional privilege is subject to
termination at any time by the Board of Directors upon determination
that such dog or other pet is vicious, is annoying to other owners or
has otherwise become a nuisance. The owner of a dog or other pet
assumes full liability for all damage to person or property caused by
such dog or other pet or resulting from the presence of such dog or
other pet at the Portofino. The pet must be able to be carried in all
common areas of the building.
2. This privilege to keep a dog or other pet at the Portofino is
granted to all owners in residence subject to foregoing conditions and
reservations, and also the following restrictions:
a. Pets are not permitted in card rooms, exercise rooms, sauna rooms,
swimming pool area, lounge, recreation rooms or lobby unless carried.
b. Under no circumstances may a pet run loose in the hallways or
anywhere else in the building or on its grounds.
c. Owner's dog or other pet must be on leash at all times when on the
grounds. Exit and entrance to the Portofino with a dog or other pet
must be through the ground level entryway.
d. A dog must not be curbed near the building, on or near walks, on or
near shrubbery or in the gardens, or in the vicinity of the lawns or
any other portion of the grounds. If pets relieve themselves on the
property, it is the unit owners' responsibility to immediately remove
and clean up after their pets.
e. Each owner is responsible for full compliance with these rules and
regulations. Failure to comply may result in action canceling the
owner's privilege of retaining a pet.
f. Visitors to the Portofino are subject to the same rules as unit
owners regarding pets.
LEASING
1. Apartment owners may lease their apartments subject to Article VIII
of the Declaration of Condominium and these Rules and Regulations:
a. An apartment may not be leased more than 2 (two) times in anyone
calendar year. However, any such lease must be for a minimum term of
at least 90 (ninety) days.
b. All such leases must be in writing upon a form approved by the Board
of Directors, and contain as minimum provisions, clauses which:
1. Prohibit subletting, under letting and rental of rooms.
2. Make such lease subject to the Declaration of Condominium as well as
the By-Laws and the Rules and Regulations of the Portofino Condominium
Assn., Inc. as amended from time to time and also designation of
Portofino Condominium Assn., Inc. as the apartment owner's agent for
the purpose of and with authority to terminate any such lease agreement
in the event of violations by the lessee of aforesaid Declaration of
Condominium, By-Laws and Rules and Regulations.
c. Any tenant(s) are to be permanent residents as opposed to transient
occupants such as those who ordinarily frequent or use hotels and
motels.
d. Before any apartment is let, application must be made, processed and
approved as follows:
1. The Board of Directors will furnish an application for lease
approval. The form will include provisions for lease cancellation for
non-compliance with the Rules and Regulations or other misconduct by
the lessee. The application for lease approval will be written in
accordance with the condominium documents.
2. A copy of the executed lease will be filed with the Board and the
apartment owner must inform the Board on the forms provided the number
of persons who will occupy the apartment during the lease period, the
length of the lease and names of occupants and such other pertinent
information as may be required. This information is to be submitted 20
(twenty) days before the intended occupancy, in order that an
investigation can be completed.
3. Upon receipt of the application for lease approval, the Board of
Directors shall have a maximum period of 20 (twenty) days to make a
proper investigation including a personal interview by an INTERVIEW
COMMITTEE WHOSE MEMBERS NEED NOT BE MEMBERS OF THE BOARD OF DIRECTORS
who will report its recommendations to the Board of Directors for its
action.
4. Apartments shall be leased for single-family occupancy only. The
number of occupants shall be limited in accordance with the normal
sleeping facilities of the apartment. An approval by the Board of
Directors shall be required each time a lease is renewed: however, the
investigation fee will be waived when the lease is renewed with the
same lessee. A fee of $50.00 (fifty dollars) must be submitted with
each new application for lease approval to offset the expense and cost
of the investigation of the lessee and also a deposit of $300.00 (three
hundred dollars) must be made with Portofino Condominium, Inc. by the
lessor to cover any damage the lessee may cause to the Common Elements
of the condominium or to the property of the Portofino apartment
owners. Refund will be made of unused portions of the deposit at the
end of the lease.
5. The owner of the apartment must supply the lessee with a copy of the
rules and inform the lessee of the importance of knowing and complying
with all house rules and regulations. Lessee must acknowledge receipt
of the copy of these rules and regulations for file in the Condominium
office. The cost of distribution of these rules and regulations will
be charged to the owner.
RESALE
1. Notice of apartment for sale shall be limited to a simple 3"x5" card
which with the Boards approval, may be placed on the bulletin board in
the lower lobby, and shall not be left there longer than 14 (fourteen)
days. Such notice may be repeated after a 30-day (thirty-day)
interval, provided that the total number of such notices shall not
exceed 3 (three). The resale must in all respects be legal and in
conformity with the legal documents of Portofino Condominium.
2. When a purchaser for a resale apartment has been found, the owner
will submit on a form prescribed by the Board of Directors, the
information necessary to conduct an investigation of the prospective
purchaser. A transfer fee of $50.00 (fifty dollars) must be submitted
at least 20 (twenty) days prior to the intended closing to provide
sufficient time for investigation and action by the Board of Directors.
3. The owner, when submitting an application for the resale of the
apartment, shall have the intended purchaser sign a statement that he
has read the Rules and Regulations and By-Laws of the Portofino
Condominium, Inc. and -agrees to abide by them. An INTERVIEW COMMITTEE
WHOSE MEMBERS NEED NOT BE MEMBERS OF THE BOARD OF DIRECTORS who will
report its recommendations to the Board of Directors for its action
will interview the intended purchaser.
4. The Board of Directors must approve the resale of any apartment in
the Portofino Condominium, Inc.
5. The Board of Directors acting for the Portofino Condominium, Inc.,
has first option to purchase any apartment, which is offered for sale.
6. The building manager should be informed in writing of any unit that
has been listed for sale. The Condo office will maintain a list of all
apartments for sale or lease. No association employee, including the
Manager, will be involved in showing such apartments or have any
interest in, or derive any profit from, the sale, resale or lease of
any apartments. Owners or their agents in all instances shall conduct
their own negotiations with the prospective purchaser and/or real
estate agent.
RECREATION FACILITIES
SWIMMING POOL
1. All persons using the pool and other recreational facilities do so
at their own risk. No liability is assumed by Portofino Condominium,
Inc.
2. Use of pool facilities is restricted to residents and their resident
guests, except that non-residents may be invited to use the pool but
not in excess of four persons as guests of one resident at anyone time,
unless authorized by the Board. A resident must accompany such
non-resident guests.
3. Pool hours for adults are posted. Children under 12 (twelve) will
not be permitted to use the pool before 9 a.m. or after 6 p.m., and
then only when accompanied by an adult.
4. Persons in bathing attire using elevators must wear shoulder and
foot covering at all times.
5. All persons must shower before entering the pool and remove all sand
and suntan oils.
6. For the protection of all concerned, persons with open blisters,
cuts, skin abrasions or with any communicable diseases are requested
not to use the pool.
7. Persons using the beach must clean tar and sand from their feet or
shoes prior to entering the building or the pool and must enter the
building at lower lobby garage entrance.
8. Poolside furniture must be protected from suntan oil and other oily
materials by use of a towel or other covering. Poolside furniture will
be returned to its normal location following use.
9. Owners and lessees will be held responsible for all actions of their
children and their guests. Boisterous conduct, screaming, running,
unnecessary splashing or the throwing of balls and other objects in the
pool or pool area will not be tolerated. A Board Member is authorized
to eject any person or persons not complying with this rule.
10. Employees of residents or of guests are not permitted to use the
pool.
11. To comply with insurance regulations, to avoid accidents and to
prevent objectionable noises, users of the pool and pool area shall not
participate in games involving running or loud shouting. Plastic ware
ONLY is permitted throughout the pool area --no glasses.
12. As a safety measure, it is advised that no person ever swim alone.
SAUNA AND EXERCISE ROOMS
1. Use of these rooms is restricted to residents and their registered
overnight' guests. No person under l8 (eighteen) or any guest of a
resident is permitted in these rooms unless accompanied by a resident.
Anyone using these rooms does so at their own risk. These rooms shall
be open 6 a.m. to 11 p.m.
2. It is suggested that before using the sauna room you have a physical
checkup and abide by your doctor's advice regarding use of the sauna.
3. Operating rules for the sauna room are posted in the shower area of
the sauna rooms.
4. Turn off the master switch when you leave the sauna.
5. Do not use the exercise room while in wet attire. Several pieces of
equipment are electrically operated and a grave danger of shock exists.
Anyone using the exercise room does so at his own risk.
6. Employees are forbidden to use any facilities of the Portofino.
DOCKING FOR BOATS
1. Portofino permits unit owners or approved tenants of unit owners to
enter into a dock lease agreement, for the purpose of docking vessels
owned by said unit owner or approved tenant within slips within the
boundaries of Portofino on an annual rental basis. Any changes to rules
and regulations during term of lease are binding on the lessor. The
unit owner or tenant shall have the right to apply to renew this
Agreement for an additional one-year term, as long as all dockage fees
and any other charges against PROPERTY OWNER/TENANT are then current
and the PROPERTY OWNER/TENANT abides by the rules established by the
ASSOCIATION.
2. A completed boat slip application and lease, with all required
documents must be approved by the Manager and Board prior to executing
the Dock Lease Agreement and mooring the boat at Portofino. If a boat
is sold during the term of the lease, any new boat acquired by the dock
lessee must complete a new dock slip application subject to the same
approval requirements as the original vessel.
3. The unit owner or tenant must provide a copy of the vessel
registration of the vessel docked at Portofino, which is in the name of
the unit owner or the entity that owns the unit. The boat owner must
carry public liability insurance as to his own property and insuring
the Portofino On the Intracoastal Condominium, Inc. against any claims
by third persons or legal entities for personal injury liability with
limits noted in the dock lease for property damage. The boat owner
will provide a certificate of insurance for both his boat as well as
any lifting device.
4. If a unit owner leases his unit, the dock lease may, at the sole
discretion of the Board, be terminated upon execution of the unit's
lease.
5. Should rental arrangements be terminated and the boat owner fail to
remove his boat from the dock within 15 days, the Portofino management
may remove the boat from her mooring space at the boat owner's risk and
expense, and retake possession of the mooring space and rental herein
before referred to shall be forfeited.
6. Docking a boat at the Portofino is a privilege granted at the
discretion of your Board of Directors. Such privilege may be
temporarily suspended or permanently revoked by the Board for violation
of its terms. Boat owners shall, at all times, exercise care and
prudence in the manner in which they use the Portofino facilities; and
they shall, more particularly, obey the following rules:
a) A boat proceeding under motor power shall make no wake. Its speed
approaching dockside should never be higher than the minimum required
to maintain steerage and headway.
b) No major engine servicing or other overhauling, painting,
refinishing or refitting shall be performed on a boat while it is at
dockside. However, routine maintenance and housekeeping of the boat
which shall not interfere with the free passage, privacy and quiet
enjoyment of others is permitted only during the hours of 8-5 pm Monday
through Friday. Except in any case of emergency, threat to life, safety
and damage to personal property. All contractors shall observe the
same rules as other contractors hired by unit owners or tenants for the
interior of the building.
c) Boat owners shall strictly obey all Laws and Ordinances of the State
of Florida and the City of Fort Lauderdale, including those applicable
to the use of sanitation facilities and willful violations thereof
shall make the docking privilege of the owner and/or the vessel
revocable following written notice and review by the Board of
Directors.
d) While docked at the Portofino, boats will not be used as overnight
or live aboard facilities. Violations of this regulation will subject
boat owners to a revocation of docking privileges. All persons must be
off the vessel by 11 pm except during docking operations.
e) No cleaning or dressing of fish shall be permitted at dockside.
f) A boat owner may install one dock box at their designated docking
space flush with the edge of the grass. This locker shall not exceed
60 (sixty) inches in overall length, 24 (twenty-four) inches in height,
nor 18 (eighteen) inches in depth. It must be kept at all times in
good repair and good appearance and must be white in color.
g) Boat owner may not reassign nor sublet his dock space. Dock
assignment is made on the boat owner's representation of present boat
ownership and that the subject dockage is for such boat. Should the
boat owner dispose of his boat and for the next 90 (ninety) days
thereafter fail to provide the Portofino management with written
evidence of a contract or other commitment to acquire a substitute
boat, the dock space in question may be reassigned.
h) Each slip may be occupied by only one vessel, unless otherwise
approved by the Board.
i) Slips 1 through 4. Vessels exceeding 20 feet in height from the
waterline, including towers, antennas, masts, arches or outriggers are
prohibited. Slips 5 through 7. Vessels exceeding 20 feet in height from
the waterline, including towers, excluding antennas, masts, arches or
outriggers are prohibited. Slips 8 through 11. Vessels exceeding 20
feet in height from the waterline, including towers, antennas, masts,
arches or outriggers are prohibited. Slips 12 through 14 have no
restrictions.
j) No commercial vessels of any type will be permitted to use dockage
space at Portofino. No commercial activities or charters of any kind
may be conducted at the Portofino dock facilities.
k) Fueling of vessels at Portofino docks is prohibited.
l) Any vessel or floating lifting device docked at Portofino must be in
working order.
m) A unit owner in the process of buying a boat may execute a lease at
the minimum boat length rate. All other requirements must be fulfilled
and a new lease applied for at the time of purchase.
n) The noise requirements of Portofino also apply to boats docked here.
Each unit owner or tenant is entitled to the quiet peace and enjoyment
of their unit. Be aware that music and noise is amplified and carried
over the water. No radio, television, hi-fi or musical instrument shall
be operated at any time in a manner which is annoying or offensive to
other occupants of the building
o) Signage not required by the state is limited to vessel name. 'For
Sale' signs are limited to 12" by 12" and two in number.
p) Flotation lifting devices are permitted with Board approval for use
with boats 35 feet or less in length. City code limits the number of
such devices to 2. Therefore approvals can be granted for only 2 on a
first requested/first granted basis. The device may not be permanently
fastened to seawall, dock or pilings. Pump motors may be mounted on the
seawall upon execution of a license agreement approved by the Board of
Directors. Lifting devices must be submerged when not occupied by a
boat, for a period of 24 hours.
RECREATION AND BILLIARD ROOMS
1. The Party and Card Rooms may be reserved for use by Owners and
Lessees Reservations must be made at least 3 (three) days in advance of
the date each of these-rooms may be required, and MUST be requested in
person. The Owner/Lessee or individual delegated by same to make such
a request MUST sign for the use of the facility desired and state the
period the reservation would cover.
2. Approved reservations for the Party and Card Rooms will include use
of the kitchen facilities. The person signing the request shall agree
to supply all help necessary for both preparation and cleanup of the
room. If our staff is required to clean up after use, the person
making the reservation will be charged for this service.
3. Items of unused food or drink found in the refrigerator of the Party
Room, or in any cupboards, will be confiscated unless permission is
given the Manager to dispose of such items. All decorations shall be
removed and carried off the premises immediately after use.
4. Owners/Lessees requesting the use of Party or Card Rooms must be
present for duration of entire affair.
5. Use of Party and Card Rooms for commercial purposes will generally
be denied. The Board of Directors, upon written application, may
individually consider exceptions to this rule.
6. Persons wishing to borrow tables, chairs or other items from the
Party Room, Card Room or kitchen must arrange for it through the
Manager's office. They will be required to sign for the items
borrowed, and to return them promptly.
7. Use of the Party Room, Card Room, kitchen, or any equipment therein
is a responsibility. By his signature, the Owner or Lessee obligates
himself for cleanup, supervision, and repair of any damages.
STORAGE COMPARTMENTS
1. Storage lockers are assigned for exclusive use by owners of
apartments to store personal belongings, baggage and sundry items.
Owners are entitled to use only the one compartment assigned to them.
All materials and objects are stored at the owner's risk.
2. The storage room door must be kept closed when the room isn't in
use.
3. Fire regulations prohibit the storage of volatile or flammable
liquids, paint thinners, paint removers, paints and lacquers in storage
compartments. The City Fire Marshal and/or Building Manager will
conduct periodic inspections to ensure compliance with these
regulations. Insurance inspectors also conduct periodic checks. The
building manager shall have the authority to enter a storage unit and
immediately remove such substance at unit owner expense.
4. Empty cartons, tires, inner tubes and like combustible materials
shall not be placed in storage compartments, but should be disposed of,
for our own safety and protection.
GENERAL RULES AND INFORMATION
Maintenance Staff
1. Our maintenance staff is available to each resident to assist in any
way to make living at the Portofino more pleasant and enjoyable. All
requests for such service shall be made through the condominium office.
2. All common area equipment failures should be reported to the Manager
immediately. These will be remedied as soon as possible or practical.
3. There may, of necessity, be a charge for all work done by our staff
in individual apartments.
4. Owners who are not in residence may contract with the Portofino
management for periodic inspection and maintenance of their apartments.
5. No Portofino Condominium Assn., Inc. employees may use any of the
recreational facilities.
Public Areas
1. All notes or bulletins will be placed on the bulletin board in the
lower lobby. Prior approval for posting notes and bulletins in lower
lobby must be secured from the condominium office.
2. Residents should refrain from engaging the Security Guards or other
Portofino employees on duty in social conversations so as to interfere
with their duties.
Assessments
1. Assessments for common expenses are due and payable quarterly during
the calendar year, on the first day of each month beginning with
January of the year for which the assessments are made as provided for
on page 5 of the Declaration of Condominium; and such assessments
become overdue 15 (fifteen) days after such due dates.
2. Cases of flagrant and repetitive delinquencies may be referred to an
attorney for collection through a lien and foreclosure proceedings with
attendant attorney's fees as provided for in the Condominium
Declaration, pages 5 and 6.
Infractions
1. Owners are responsible for damage to, or any defacing of, the common
areas, which they, their contractors, children, guests, lessees or pets
may cause. The Board of Directors is authorized to assess the owner
involved the cost of repairs.
2. Generally, misconduct, offensive behavior, any rule violation or
illegal acts (violation of state or local laws, ordinances, or
regulations) should be reported in a signed statement to the Board for
investigation, or corrective action as provided by these rules and
regulations.
3. No owner or resident is authorized to reprimand or give orders to
any other owner, their quests or to employees of the association.
Infractions of rules and any criticism of association employees are to
be reported to the Building Manager or the Board of Directors.
Package and Luggage Carts
1. Return carts to lower lobby immediately after you have finished with
their use. Take them to the lower lobby storage area. Do not leave
them on the elevators, in your own apartment, or in the hall.
