Property tax and association dues are completely different things.
Property tax means that the person doesn't own their own property, they
just have a transferrable rental agreement. In a HOA, you *actually*
do not own "your" house, it's in the original agreement. Association
dues are agreed when you aquire the property, including the mechanism
for increasing the dues. To declare association dues unconstitutional
would be to strip people of their right to freedom of contract, this is
a fundamental cornerstone of capitalism.

In any case, the reason the government is restricted is that they can
force you to do stuff. A market deal doesn't need to be restricted as
the two (or more) people involved agree to it without being forced.
The property owners never agreed to pay property tax when they bought
their property, but a HOA house owner did agree to pay the dues without
a gun being put to their head. It may have been a bad decision, but
they did agree to it.

You complain that HOA's are communistic, but your solution, ban them,
is actually what is communistic. A capitalist doesn't try to get the
government to stop people from doing things that he doesn't agree with,
even if they are doing stupid things (assuming it has nothing to do
with him). People can spend their money on anything they want. If
HOAs are really a bad idea, then people who buy will lose money and
won't be participating in housing market anymore. This is capitalism,
money goes from people who make poor decisions to those who make better
ones. In the end, all decisions are made by those who are good at
those decisions.
