Our (California) HOA has not taken any action to enforce speed limits and
stop signs on the private streets in our gated community. They have been
sent several certified letters informing them of the extremely dangerous
levels of speeding and ignoring stop signs.
They had a professional traffic study done about 1.5 years ago which
recommended Education, Enforcement and Engineering. To date they have not
even sent out notices reminding people to slow down/stop at stop signs, much
less set up third party traffic enforcement or any traffic calming items.
They did however set up a circus of a 'safety' committee which was voted
into place. The speeders far outnumber the affected residents (about 20
affected homes out of 107 in this gated community-there are several others
in our HOA) and they stacked the committee with speeders. They made some
very illogical suggestions to the Board, which would actually INCREASE
speeding, for example, create a no parking zone on the affected street. It
is a fact that parked cars slow down traffic. The HOA also painted a double
yellow line down the street, another huge mistake as it also is shown to
increase speeding on residential streets and is discouraged by most cities.
Do you think this situation which has gone on for over three years might be
considered gross negligence by the Board of Directors? Can they be held
liable if a tragedy occurs? There are several easy to implement solutions
well within their grasp which they have neglected to put into place. Board
members have stated they are concerned that residents might be upset if they
spend HOA money to enforce the speed limit. Any suggestions?
