I am wondering if our survey is in error and thought someone here could
clear things up.
There are differences in the new survey compared to the old one done 30
years ago.
Two years ago when we were tearing down our old house to make way
for a new modular home we had to have a new survey done.
The '76 survey was based on the original land survey of the area & was
done in
1946 from a plot survey dated 1923. The new survey was a full survey
to satisfy
the town building department. I spoke to the surveyor and he stands by
the new survey.
The problem? My next door neighbor, she's always pushed her property
lines as far as she could, putting up sheds that end just inside the
property line, fences, etc. Not just with me, but with her other
neighbors as well. Now she wants me to cut my new driveway and put a
culvert in to divert the rain runoff. (PS: her fence on that side is
clearly on my property -- from either survey).
The new survey reads differently -- not by a lot, but it puts her shed
directly on the
property line & her fences well over it on to my property.
My question, how accurate is this new survey compared to the original
1945 survey, which was taken from the land survey records dated 1923?
I was thinking that the newer survey would be more accurate, but have
noticed the numbers are different. I know we're only talking about a
small difference in the actual property line, but just how big is it?
These are the numbers from the new survey:
S 79-29-07E (front corner of property)
207.84 (rear corner of property)
These are the original survey numbers:
S 79 degrees 39' 56" E (front corner of property)
207.6 (rear corner of property)
The rest of the numbers are exactly the same as the original.
I hope somone can make some sense out of this.
